In the context of this agreement, the terms listed below hold the meanings ascribed to them:
‘The Owner’ refers to 360 Snap Shot Adelaide (ABN: 60 675 508 915).
'360 Snap Shot Adelaide' signifies the directors ALEKSANDAR STAKIC & DANIEL TERRERI.
‘The Hirer’ denotes the individual, organization, partnership, or entity that is renting the Goods, as detailed in the booking order form.
‘The Goods’ pertains to a 360 Snap Shot Adelaide 360 photo booth provided by 360 Snap Shot Adelaide.
‘Claims’ indicates any legal claims or requests.
Hiring
By paying any portion of the invoice, the Hirer agrees to the Terms & Conditions.
Deposits made to reserve the Hirer's date are non-refundable.
Any fancy dress props (if utilized) should be returned in good condition at the conclusion of the event; otherwise, a cleaning or replacement fee may be charged.
Space and Power Requirements
360BOOTH – Minimum floor space of 3m x 3m
Access to a 240v 10A power source must be available within 3m of the setup site.
Privacy
360 Snap Shot Adelaide will not share the Hirer’s information with any third party and will implement reasonable steps to keep client details confidential.
Hiring, Delivery, Service, and Additional Charges
The delivery, setup, and removal of the photo booth are complimentary within a 20km radius of Adelaide CBD, 5000. A travel fee will apply for events beyond this distance.
Attendant Care: Provide time for meal & bathroom breaks for the operators.
The setup and removal of the photo booth will not fall within the rental duration. The Hirer is responsible for obtaining approval for the booth's placement from the venue.
360 Snap Shot Adelaide agrees to have a photo booth operational for at least 80% of the rental period; otherwise, a discount may be applied. Downtime for maintenance or replenishment of supplies may be necessary.
The quality of outdoor photographs can vary significantly based on environmental conditions, and while 360 Snap Shot Adelaide will strive for quality, consistent image quality cannot be guaranteed for outdoor events.
The cost for delivery and setup is included in the rental fee, provided the setup time does not exceed 1 hour prior to the hire period. If setup is required more than 1 hour ahead of the event, an additional charge of $30 per extra hour will be applied unless agreed otherwise with 360 Snap Shot Adelaide.
Booking deposits require 35% of the total price due to the unlikely events of cancellation.
Flexible Cancellation: Get a full refund, less than 15%, up to two weeks before the event. Inside two weeks of the event, deposit is non-refundable
If the equipment needs to be carried up stairs, the support staff from 360 Snap Shot Adelaide will require physical assistance. A $30 setup fee may apply if assistance cannot be rendered.
Extented celebration: If the festivities demand more time, an additional charge of 1.5x the per hour rate will apply.
Large Corporate Events: For events greater than 250 attendees, a supplementary fee of $200 is applied to facilitate an extra attendant. This secures safety, operational smoothness & a requirement due to insurance purposes.
Terms and Conditions: Non-Payment and Service Suspension
1. Payment Terms
1.1. All invoices issued by Stakic & Terreri PTY LTD must be paid in full within 7 days from the invoice date, unless otherwise agreed in writing.
1.2. If payment is not received within this period, the client will be considered in default, and the outstanding amount will become immediately payable.
2. Right to Withhold Services
2.1. If payment is not received by the due date, Stakic & Terreri PTY LTD reserves the right to immediately suspend all services until full payment is received.
2.2. In cases where payments remain outstanding for more than 7 days, Stakic & Terreri PTY LTD is under no obligation to continue providing any services to the client.
2.3. If full payment is not made within a few hours before the scheduled event, Stakic & Terreri PTY LTD reserves the right to cancel the service and retain the deposit as compensation for lost business and time.
3. Refunds and Retained Payments
3.1. Stakic & Terreri PTY LTD reserves the right to withhold any deposits or payments made by the client in the event of non-payment.
3.2. Should the client fail to pay the outstanding amount within 7 days of the due date, Stakic & Terreri PTY LTD is entitled to retain any payments already made, including deposits, and will not issue refunds under these circumstances.
3.3. Stakic & Terreri PTY LTD is entitled to keep all payments received as compensation for time, resources, and any services rendered up to the point of termination or suspension.
4. Termination of Contract
4.1. Stakic & Terreri PTY LTD reserves the right to terminate the contract if payment remains outstanding after 7 days from the original due date.
4.2. Upon termination, all services will cease, and Stakic & Terreri PTY LTD will retain the right to any monies already paid without further obligation to the client.
5. Client Responsibility
5.1. It is the client's responsibility to ensure that payments are made on time. Failure to do so will result in the withholding of services, with no liability on Stakic & Terreri PTY LTD for any delays or losses incurred by the client due to suspension.
5.2. If full payment is not made within a few hours of the scheduled event, Stakic & Terreri PTY LTD reserves the right to cancel the service and retain the deposit.
